Artist Terms of Service
Effective August 2, 2026
These Artist Terms of Service govern artist accounts and content submitted to FloridaGigs.com. By creating an artist account, submitting content, or using the artist portal, you agree to these Terms.
1. Artist eligibility
You must be at least 18 years old and legally able to enter into this agreement. You may create an account for yourself, a band, duo, musical group, DJ, entertainment act, or another artist you are authorized to represent.
2. Artist accounts
You are responsible for maintaining accurate account information, protecting your password, and all activity performed through your account. FloridaGigs may approve, reject, suspend, or remove an account when necessary to protect the website, its users, artists, venues, or the accuracy of the directory.
3. Gig information
You agree to submit only gig information you reasonably believe is accurate. You are responsible for updating or removing canceled, postponed, relocated, or materially changed performances. FloridaGigs may correct formatting, merge duplicates, or remove inaccurate or outdated listings.
4. Artist content
Artist Content includes artist names, biographies, photographs, logos, graphics, links, gig descriptions, and other information you submit. You retain ownership of your Artist Content.
By submitting Artist Content, you grant FloridaGigs a nonexclusive, worldwide, royalty-free license to host, store, reproduce, resize, format, display, distribute, and promote that content for purposes connected with operating and marketing FloridaGigs. This may include artist pages, venue pages, calendars, search results, social-media posts, emails, and promotional materials.
5. Your content responsibilities
You represent that:
- You own the content or have permission to use it.
- The content does not violate copyright, trademark, privacy, publicity, or other legal rights.
- The content is not knowingly false, misleading, defamatory, unlawful, or harmful.
- You have permission to use photographs or artwork submitted through your account.
6. Prohibited conduct
You may not:
- Impersonate another artist, venue, person, or organization.
- Submit fake performances or misleading event information.
- Create duplicate or fraudulent accounts.
- Upload malicious code or interfere with the website.
- Use FloridaGigs to send spam or unsolicited mass messages.
- Submit illegal, threatening, hateful, sexually explicit, or abusive content.
7. Artist and venue relationships
FloridaGigs is a live-music directory and promotional platform. FloridaGigs is not a booking agency, artist manager, talent buyer, employer, or party to agreements between artists and venues. Artists and venues are solely responsible for confirming performances, compensation, equipment, insurance, licenses, permits, cancellations, and other performance arrangements.
8. No guarantee of results
FloridaGigs does not guarantee attendance, bookings, income, search placement, social-media exposure, accuracy of third-party information, or uninterrupted operation of the website.
9. Moderation and removal
FloridaGigs may review, edit, decline, suspend, or remove content or accounts that violate these Terms, infringe another person’s rights, contain inaccurate information, create a safety concern, or harm the usefulness or reputation of FloridaGigs.
10. Copyright complaints
Copyright concerns may be sent to Steve@floridagigs.com. Please identify the copyrighted work, the material at issue, your contact information, and the basis of your complaint.
11. Account termination
You may request deletion of your artist account by contacting Steve@floridagigs.com. FloridaGigs may suspend or terminate access for violations of these Terms, fraud, repeated inaccurate submissions, security concerns, or misuse.
12. Privacy
Use of the artist portal is also governed by the FloridaGigs Privacy Policy.
13. Service changes
FloridaGigs may add, change, suspend, or discontinue features. We may update these Terms and will post a revised effective date when changes are made.
14. Disclaimer
To the fullest extent permitted by law, FloridaGigs is provided on an “as is” and “as available” basis, without warranties regarding availability, accuracy, reliability, fitness for a particular purpose, or noninfringement.
15. Limitation of liability
To the fullest extent permitted by law, FloridaGigs and its owners, officers, employees, contractors, and representatives will not be liable for indirect, incidental, special, consequential, or punitive damages arising from use of the website, canceled or inaccurate performances, disputes between artists and venues, lost income, unauthorized third-party use of content, outages, data loss, injuries, or property damage.
16. Indemnification
You agree to defend and indemnify FloridaGigs from third-party claims arising from content you submit, your violation of these Terms, your infringement of another person’s rights, or your performance and venue relationships.
17. Governing law
These Terms are governed by Florida law. Legal actions relating to these Terms will be brought in the appropriate state or federal court serving Lake County, Florida, unless applicable law requires otherwise.
